• Scrape, crawl, or use automated means to access the Services without our written consent
• Interfere with or disrupt the integrity or performance of the Services
• Send spam, unsolicited communications, or bulk messages through our platform
• Use the Services to harass, abuse, or harm another person

6. Recruitment Services

6.1 No Guarantee of Employment

Nikapartners acts as a facilitator between candidates and employers. We do not guarantee employment, placement, or any specific outcome from using our Services. All hiring decisions are made by the respective employers.

6.2 Candidate Profiles

By submitting your resume or profile, you authorize Nikapartners to share your professional information with potential employers and clients for recruitment purposes. You may request removal of your profile at any time by contacting us.

6.3 AI-Powered Features

Our Services may use artificial intelligence and machine learning technologies to analyze resumes, extract job requirements, and provide matching recommendations. While we strive for accuracy, AI-generated results are provided as recommendations and should not be relied upon as the sole basis for hiring or career decisions.

7. Browser Extension

Our Chrome browser extension ("NikaPartners Job Extractor") is subject to these Terms. By installing and using the extension, you additionally agree that:

• The extension will read page content only when you actively initiate a job extraction
• Extracted job data will be sent to our servers for AI processing and storage
• You will only extract job listings that are publicly available or that you have authorization to access
• You will not use the extension for scraping or bulk data collection purposes

8. Email Communications

By using our Services, you consent to receiving transactional emails related to your account, job matches, and service notifications. You may opt out of non-essential communications at any time. Emails sent to our designated inboxes (e.g., candidates@nikapartners.com, jobs@nikapartners.com) may be automatically processed for recruitment purposes.

9. API Usage

If you access our Services through our public API, you agree to:

• Use the API only for its intended purpose and in compliance with our documentation
• Not exceed reasonable rate limits or usage thresholds
• Keep your API credentials secure and not share them with unauthorized parties
• Accept that we may monitor, throttle, or revoke API access at our discretion

10. Fees and Payments

Certain features or services may require payment. All fees will be clearly communicated before you incur any charges. Payment terms, if applicable, will be specified in a separate agreement or on the relevant service page. We reserve the right to change our pricing with reasonable notice.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIKAPARTNERS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Indemnification

You agree to indemnify, defend, and hold harmless Nikapartners and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your User Content, or your violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved in the state or federal courts located in Harris County, Texas.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
